Hammond, however, is not entitled to withdraw his plea to the charge of possession of a firearm by a felon, at least not yet. The court must first rule on his motion to suppress the evidence of the guns found in the tattoo shop based on the evidence at the new hearing. As in People v. LeBlanc, supra, 60 Cal.App.4th 157, we are not ordering the exclusion of any evidence but are directing the trial court to determine whether evidence should be excluded after Hammond has the opportunity to testify.
