In Delgamuukw v. British Columbia, 1987 CarswellBC 1142 (S.C.), in the context of an Indian lands’ claims trial, the defendants were being asked to categorize documents. McEachern C.J. said at ¶25: Like Dohm J., I am not aware of any rule or practice that authorizes an order for categorization of documents by legal issue particularly where something in the order of 10,000 documents has been produced. Rule 26 requires a list of documents which “…shall enumerate the documents in a convenient order with a short description …”. The Attorney General for B.C. has at least provided a chronological list although that would not necessarily be required as long as the documents are listed conveniently. Listing by subject matter may be more convenient than a chronological list. …
