The following excerpt is from People v. Thoreson, A147164 (Cal. App. 2017):
There is no time limit on the right to move for correction by the trial court of legal errors in sentencing. (People v. Fares (1993) 16 Cal.App.4th 954, 958, 960.) However, the basis of appellant's claim that he is now serving an unlawful sentence is apparently that he is entitled to the custody credits which in our 2007 opinion we found he had waived.
