Is there a rule of non-inquiry?

There is no constitutional or statutory command establishing a rule of non-inquirythat is, a rule precluding any substantive judicial inquiry into the likely fate of extradited criminal defendants.³⁰ Rather, the traditional principle that has been dubbed the "rule of non-inquiry" developed as a judge-made doctrine, under which "[a]n extraditing court will generally not inquire into the procedures or treatment which await a surrendered fugitive in the requesting country." Arnbjornsdottir-Mendler v. United States, 721 F.2d 679, 683 (9th Cir. 1983).
