When can a party refuse to purchase a lot on a plan?

The following excerpt is from Carey v. Toronto (City), 1885 CanLII 23 (ON CA):

The plan is, by reference, unquestionably incorporated into the contract to some extent, and if the case was to be determined by considerations of convenience, or of the inducements which probably operated upon intending purchasers of lots as laid out on this plan, it cannot be denied that the right contended for is of great importance to the plaintiff, and if the defendants were at liberty to refuse it. I have very little doubt that they could not have forced the purchase upon him: Myers v. Watson, 1 Sim. N.S., 523.
