The following excerpt is from Moriarty v. Bartlett, 1 N.E. 794, 99 N.Y. 651 (N.Y. 1885):
Proc. We are also of that opinion, and having in the case of Hegerich v. Keddie, ante, 787, decided at this term, held that such a cause of action does not survive, we think this case is controlled by that decision.
The orders of the general and special terms should therefore be reversed, and the application denied, with costs in both courts.
