The following excerpt is from 418486 B.C. Ltd. v. Pyxis Investment Corporation et al., 2000 BCCA 305 (CanLII):

As to the question whether leave is required, I do not think I could successfully distinguish this case from the decision in Eusanio v. Janolino (1998), 28 C.P.C. (4th) 211 (B.C.C.A.). It follows that I am of the view that leave is not required in this case. I will add that, if I thought leave was required, I would grant it.
