What is the standard of proof and what is the test for liability and damages?

Ontario, Canada

I disagree. It has been clear since Snell v. Farrell, 1990 CanLII 70 (SCC), [1990] 2 S.C.R. 311 that the onus is on the plaintiffs throughout to prove liability and damages, and the standard of proof is the balance of probabilities.
