Is a plaintiff entitled to claim damages from an insurer for bad faith?

California, United States of America

The following excerpt is from Hulett v. Farmers Ins. Exchange, 10 Cal.App.4th 1051, 12 Cal.Rptr.2d 902 (Cal. App. 1992):

Defendant also claims the instant case bears a "striking resemblance" to Carlile v. Farmers Ins. Exchange (1985) 173 Cal.App.3d 975, 219 Cal.Rptr. 773. This claim is incongruous. Carlile dealt with the limited issue of whether an insurer was liable for bad faith when the insurance policy had a clause allowing the insured to refuse to consent to a settlement. (At p. 977, 219 Cal.Rptr. 773.)
