Is a defendant's unconditionally guilty plea valid in a criminal case?

MultiRegion, United States of America

The following excerpt is from United States v. Kerr, Docket No. 10-3393-cr(con), Docket No. 11-5462-cr(L) (2nd Cir. 2014):

improprieties, the denial of his motion to dismiss the indictment, and various trial errorsare therefore barred by his valid guilty plea. See United States v. Lasaga, 328 F.3d 61, 63 (2d Cir. 2003) ("A defendant who pleads guilty unconditionally admits all elements of the formal charge and, in the absence of court-approved reservation of issues for appeal, waives all challenges to prosecution except those going to the court's jurisdiction.").

For the foregoing reasons, we affirm the judgment of the district court.
