Is a defendant's ineffective assistance of counsel ineffective in his application for a certificate of probable cause?

California, United States of America

The following excerpt is from People v. Conner, B193988 (Cal. App. 6/26/2007), B193988 (Cal. App. 2007):

With respect to the ineffective assistance of counsel claim, given the negotiated plea by which defendant agreed to permit the court to sentence him to a four-year term, issuance of a certificate of probable cause would not have been authorized had one been requested. (See People v. Shelton, supra, 37 Cal.4th at p. 770; People v. Berutko (1969) 71 Cal.2d 84, 94.)
