The following excerpt is from People v. Weddington, 200 Cal.Rptr.3d 799, 246 Cal.App.4th 468 (Cal. App. 2016):
the trial court to exercise its discretion regarding their sentences on the count 8 conviction. However, because appellants failed to request that the trial court treat the conviction for possession of burglary tools as a misdemeanor and did not object to the trial court's discretionary sentencing choice, we conclude appellants' claim is forfeited. (People v. Scott (1994) 9 Cal.4th 331, 356, 36 Cal.Rptr.2d 627, 885 P.2d 1040.) In any event, the record does not support appellants' contention that the trial court was unaware of the scope of its sentencing discretion. Remand is therefore unwarranted in this case.
