Manitoba, Canada

The following excerpt is from Attorney General of Manitoba and Swan Valley Municipal Airport Commission et al. v. Campbell, 1983 CanLII 3687 (MB QB):

The principles governing the issue of an interlocutory injunction in Mani- toba are those set out in Lambair Lim ited v. Aero Trades Western Limited, [1978] 4 W.W.R. 397, per Matas, J.A., at pp. 404-5. In a judgment which was unanimous on this issue, the court, in adopting the general test of a prima facie case, approved English jurispru dence to the effect that each case must be tested on a basis of fairness, jus tice and common sense in relation to a whole of the issues of fact and law rel evant to the particular case.
