Although not a death penalty assurance case, the importance of obtaining conditions with respect to a surrender was discussed in India v. Badesha, 2017 SCC 44. India sought the extradition of two Canadian citizens to stand trial for conspiracy to commit murder. The Minister made the surrender order conditional on receiving assurances from India that the Canadians would not face the death penalty if they were convicted in India.
