Independent Tank Cleaning v. Zabokrzycki dealt with the claim by the landlord’s insurer against the tenant where there was not a current written lease agreement, rather a previous lease which had expired. It contained a provision about a proposed lease which had never been signed. The Court of Justice summarily dismissed the landlord’s claim against the tenant.
