The following excerpt is from König v. Hobza, 2013 ONSC 5531 (CanLII):

König relies on Arthur v. Signum Communications Limited et al., [1991] O.J. No. 86 in support of his submission that he is entitled to substantial indemnity costs. In Signum, Austin J., as he then was, stated that a finding of oppression, by definition, “almost always provides some foundation for an award of costs above and beyond the party and party scale.”
