Outside of contractual provisions (such as those typically found in mortgage agreements, for example) or specific statutory or regulatory provisions, costs between parties on the solicitor-and-client scale are generally awarded only in exceptional circumstances, such as “where there has been reprehensible, scandalous or outrageous conduct on the part of one of the parties”.
