The following excerpt is from The People v. Mendoza, C061047, No. 06F00291 (Cal. App. 2010):

Thus, any inadvertent suggestion as to the order in which the jury may be considering the offenses was not likely, when considered with the other instructions as a whole, to have indicated to the jury that it was precluded from considering the lesser offenses. (See People v. Dennis (1998) 17 Cal.4th 468, 536-537.)
