In appellant's direct appeal in 2005, we reversed his two convictions for attempted murder based on instructional error, [5] but otherwise affirmed the judgment. In 2018, appellant filed a petition for writ of habeas corpus seeking relief under People v. Chiu (2014) 59 Cal.4th 155, 158. The trial court denied the petition, and explained that the jury had not been instructed on aider and abettor liability for first degree premeditated murder under the natural and probable consequences doctrine.
