In Kennedy v. Kennedy (1994) 98 B.C.L.R. (2d) 287 (B.C.S.C.) Madam Justice Newbury commented in para. 16 that there were many B.C. cases in which family assets have been reapportioned in favour of wives because they have been out of the job market for significant periods of time and therefore have reduced income-earning ability or because they require the use of particular assets such as the matrimonial home in order to be able to pursue educational opportunities or to upgrade job skills.
