Neither of those decisions supports the plaintiffs’ argument. In fact, the decision in Jansen v. Fidelity and Casualty Company of New York demonstrates that by carrying out inspections with a view to reducing the risk of loss an insurer does not place itself in such proximity to potential “victims” that direct liability to them can arise.
