In an action to enforce the HSTA, is the prevailing party entitled to attorneys' fees?

MultiRegion, United States of America

The following excerpt is from Goding v. Ariyoshi, 878 F.2d 385 (9th Cir. 1989):

In actions to enforce 42 U.S.C. Sec. 1983 claims, a court has discretionary power to award a prevailing party reasonable attorneys' fees. See Molina v. Richardson, 578 F.2d 846, 854 (9th Cir.), cert. denied, 439 U.S. 1048 (1978). We decline to award HSTA attorneys' fees.
