2. Appellant arguably forfeited this claim by failing to raise it in the trial court. But because he asserts his trial attorney was ineffective for not bringing it up below, we will consider the claim on its merits to forestall a future habeas corpus petition on the issue. (See People v. Butler (2003) 31 Cal.4th 1119, 1128.)
