We agree that the procedures followed in this case were somewhat irregular, due in part to the prosecution's sudden discovery during trial of the newly enacted section 1109. It would certainly have been better if the trial court had explained to the jury that its preliminary limiting instruction was wrong and that the evidence of past conduct could be considered to show that defendant had a present disposition to commit domestic violence offenses.
