It is also trite law that the respondent's obligation to execute a removal order "...as soon as reasonably practicable" provides a degree of discretion to a removals officer to defer removal in appropriate circumstances. In Simoes v. Canada (Minister of Citizenship and Immigration)2, my colleague Mr. Justice Nadon wrote at paragraph [12]:
