Before making any adjustment for totality, the foregoing would result in a gross sentence of 750 days. Clearly, this is excessive, and requires adjustment. While the entire series of offences could be considered a spree, it can be classed as two events. These are the drunk driving (and related breaches) up to the point of the accident, and then the assault (and related breaches) after the accident. The impaired driving charge will be stayed, following Kienapple v. R., 1974 CanLII 14 (SCC), [1975] 1 S.C.R. 729.
