In his statement of claim, the Husband claims punitive or aggravated damages. Punitive damages are only available where the nature of the conduct is such that it is deserving of punishment because it is harsh or reprehensible. If the misconduct of the employer in dismissing the employee could amount to an independent cause of action for mental distress or loss of reputation, the employee may recover aggravated damages: Vorvis v. Insurance Corp. of British Columbia, 1989 CanLII 93 (SCC), [1989] 1 S.C.R. 1085.
