In the circumstances, therefore, there is no genuine issue requiring a trial with respect to liability or damages. The facts are clear, well-supported and uncontradicted, making this an appropriate case for summary judgment: Hryniak v. Mauldin, 2014 SCC 7 at para. 49. Accordingly, I grant judgment for the plaintiff.
