How have the facts been interpreted in a civil case?

California, United States of America

The following excerpt is from People v. Smith, D048913 (Cal. App. 6/10/2008), D048913 (Cal. App. 2008):

As the parties acknowledge, the witnesses to the incidents in question gave widely divergent statements to police and testimony at trial as to the underlying facts. In the absence of a challenge to the sufficiency of the evidence to support the convictions and in accordance with the applicable standard of review, we do not describe these variations in the evidence in great detail, but instead primarily recite the facts as established by the record when viewed in the light most favorable to the judgment (see People v. Davis (1995) 10 Cal.4th 463, 509).
