How have the courts dealt with allegations of prosecutorial misconduct?

California, United States of America

The following excerpt is from People v. Woodruff, 235 Cal.Rptr.3d 513, 421 P.3d 588, 5 Cal.5th 697 (Cal. 2018):

Defendant claims there were five instances of prosecutorial misconduct. We consider them in order. "With regard to some of the points raised in this section, defendant registered no objection to the purported acts of misconduct, and there is no reason to believe that any harm could not have been cured. Those points must therefore be rejected on procedural grounds." ( People v. Osband (1996) 13 Cal.4th 622, 693, 55 Cal.Rptr.2d 26, 919 P.2d 640.) Moreover, we see no prejudice or general misconduct even if defendant had objected.
