Though the Cartwright Act is written in absolute terms, in practice not every agreement within the four corners of its prohibitions has been deemed illegal. (Morrison v. Viacom, Inc. (1998) 66 Cal.App.4th 534, 540, 78 Cal.Rptr.2d 133.) Business and Professions Code sections 16720, 16722, and 16726 draw upon the common law prohibition against restraints of trade.
