The following excerpt is from The People v. Moreno, F056999, Super. Ct. No. VCF196298 (Cal. App. 2011):
Appellant argues the trial court violated section 654, 3 which prohibits punishment for two offenses arising from the same act or from a series of acts constituting an indivisible course of conduct (People v. Latimer (1993) 5 Cal.4th 1203, 1216; People v. Harrison (1989) 48 Cal.3d 321, 335), when it imposed a separate, consecutive sentence on count 2. According to appellant, the attack on J.M. was a single indivisible course of conduct. We disagree.
