A trial judge’s findings of fact are entitled to deference from an appeal court unless they are born of a palpable and overriding error, see Housen v. Nikolaisen 2002 SCC 33 (at para. 10). The standard of review on questions of law is that of correctness, see Housen v. Nikolaisen (supra at para. 8).
