The parties agree that the standard of review framework in Housen v. Nikolaisen, 2002 SCC 33, [2002] 2 S.C.R. 235 applies to this appeal. For extricable questions of law, the standard is correctness (para. 8). For questions of fact, it must be established that the judge made a “palpable and overriding error” (para. 10). For mixed questions of law and fact, the stricter standard applicable to pure questions of facts also applies (para. 29).
