In any event, even if the court had jurisdiction to hear the application, it is within a trial judge’s discretion to dismiss an application for habeas corpus where an alternative remedy is open to the applicant: see Goldhar v. the Queen (1960), 1960 CanLII 65 (SCC), 25 D.L.R. (2d) 401 (S.C.C.).
