When I consider the elements of defamation as set out in Grant v. Torstar at para. 28, in context with the stage of these proceedings, I am satisfied that there are grounds to believe that the claim has substantial merit. In other words, I am satisfied that the claim has a real chance of success. The Township published online a number of letters that could tend to lower the plaintiffs’ reputation in the eyes of a reasonable person. The words published clearly identified the plaintiffs. Lastly, the words were communicated online for a period of time, allowing anyone to access, download and disseminate the comments.
