Justice Molloy referred to the distinction in the cases between the exercise of government discretion on a matter of policy and government action that is properly characterized as operational. In the case of the former, the government action is outside the scope of any private law duty of care. In the case of the latter, there is no exemption from tort liability: Just v. British Columbia, 1989 CanLII 16 (SCC), [1989] 2 S.C.R. 1228, 64 D.L.R. (4th) 689, 41 B.C.L.R. (2d) 350.
