In Gluska v. Port Moody (City), [2002] B.C.J. No.1924 (S.C.) Loo J. ordered that each party bear their own costs because the petitioner was not the only concerned citizen, and the application was not a frivolous one. That also was an application to set aside a zoning bylaw, although apparently involving environmental concerns.
