General damages, or non-pecuniary damages, are awarded to compensate a claimant for their pain and suffering resulting from the battery. Proof of physical injury is not a requirement. A schedule or tariff setting out the amount of damages for pain and suffering based on the seriousness of the injuries does not exist because each person experiences pain and suffering differently. The determination of damages is a subjective matter, taking into consideration the following factors referred to in the case Stapley v. Hejslet, 2006 BCCA 34, at paragraph 46:
