13 While it is my strong view that the plaintiff should not be put to this kind of expense, and that if it is forced to do so, and is successful, costs should be dealt with according to Fullerton v. Matsqui. I am not determining here whether or not the actions of a party are such that the court should evidence its unhappiness by ordering such costs.
