I am also referred to the decision of From v. From (1980), 35 N.S.R.(2d) 49; 62 A.P.R. 49. In this case, the justice hearing the case purports to make a maintenance order binding upon the estate. The judgment in part reads: The obligation to make maintenance payments is expressed to be binding upon the estate of the respondent in the event of his death, to enable the court to determine, in that event, whether and to what extent the death of the respondent affects that obligation.
