There has been some discussion in the case law about the nature of the franchisor-franchisee relationship. Courts have recognized that there is a common law duty of good faith between a franchisor and a franchisee. There is no fiduciary duty: Jirna v. Mister Donut of Canada, 1973 CanLII 31 (SCC), [1975] 1 S.C.R. 2.
