The employer referenced R v. Fountain Tire (olds) LTD., 2011 ABPC 236, at paragraphs 152 to 155. I do not consider this case analogous to the matter before me. In Fountain Tire, an employee disregarded the direction of his supervisor to perform work in a safe manner. He knowingly, and for reasons unknown to the supervisor, filled a tire outside of the safety cage despite being told not to do so, and was seriously injured when the tire rim ruptured.
