There is no evidence for ad hoc fiduciary duties. For those to arise, "it is fundamental … that there be an undertaking by the fiduciary, which may be express or implied, that the fiduciary will act in the best interests of the other party": Galambos v. Perez, 2009 SCC 48 at para. 66.
