Section 11 does not apply to extradition proceedings at all because the fugitive is not charged with an offence by one of the governments to which the Charter applies pursuant to s. 32: Republic of Argentina v. Mellino (1987), 1987 CanLII 49 (SCC), 28 C.R.R. 262 (S.C.C.).
