Generally, an owner whose property is considered for expropriation has a right to a hearing. Courts have repeatedly acknowledged the importance of protecting the vulnerable position of owners subject to expropriation: Smith v. Alliance Pipeline Ltd., 2011 SCC 7 at para. 55.
