Enright v. Marwick, 2002 BCSC 638, aff’d 2004 BCCA 259, is a case in which a vehicle struck a pedestrian in a crosswalk. It was a dark wet evening and the pedestrian stepped out into the crosswalk when the defendant’s vehicle was too close to stop. The court dismissed the plaintiff’s case.
