The process an employer must follow in exercising its discretion was set out in Coppin v. Canada Revenue Agency, 2009 PSLRB 81, a case involving discretionary leave due to winter storms. In exercising its discretion, the employer must examine each request and its series of facts individually, and its decision must be based on the merits of each request.
