The following excerpt is from Hallworth v. Hallworth, 1987 CanLII 2661 (BC SC):

I am satisfied that, in this case, the defendant has discharged the onus of showing that his application is not in the nature of a “fishing expedition”. In such circumstances, it is clear from the decision in Dufault v. Stevens that, unless there are compelling reasons to the contrary, the application should be granted. Nothing was filed to substantiate any such compelling reason and the doctors themselves did not oppose the application.
