The School District argues there is a significant gap in time between the timely and untimely allegations. It argues they are not of the same character. The complainant bears the burden of establishing continuing contravention: Dove v. GVRD and others (No. 3), 2006 BCHRT 374 at para. 21.

Given the findings in SD v. P, A’s general statement that there is ongoing discrimination is not sufficient, on its own, to establish continuing contravention.
